FI401 FISH RESOURCES MANAGEMENT ACT 1994 PROHIBITION ON FISHING (BARDI JAWI GAARRA MARINE PARK) ORDER 2025 A34823 Made by the Minister under section 43. 1. Citation This instrument is the Prohibition on Fishing (Bardi Jawi Gaarra Marine Park) Order 2025. 2. Commencement This instrument comes into operation as follows— (a) clauses 1 and 2—on the day this instrument is published in the Gazette; (b) the rest of the clauses—on the day after that day. 3. Interpretation In this order— commercial operations licence has the same meaning as in the Conservation and Land Management Regulations 2002; crab means fish of that common name described by the scientific classification opposite that name in Division 3 of Schedule 7 to the regulations; mackerel means fish of that common name described by the scientific classification opposite that name in Division 1 of Schedule 7 to the regulations; Sanctuary area means a zone or zones specified in Schedule 1; sea cucumber means fish of that common name described by the scientific classification opposite that name in Division 5 of Schedule 7 to the regulations; Special Purpose area (biocultural conservation) means a zone or zones specified in Schedule 3; Special Purpose area (cultural protection) means a zone or zones specified in Schedule 2; specimen shell has the same meaning as in the Specimen Shell Managed Fishery Management Plan 1995; trochus means fish of that common name described by the scientific classification opposite that name in Division 4 of Schedule 7 to the regulations. 4. Prohibitions on fishing (1) A person must not fish by any means in a Sanctuary area. (2) A person must not fish by any means in a Special Purpose area (cultural protection). (3) A person must not fish for a commercial purpose in a Special Purpose area (biocultural conservation). 5. Exceptions to prohibitions (1) Clause 4(1) does not apply with respect to a person engaged in customary fishing. (2) Clause 4(2) does not apply with respect to a person— (a)
