Terms of Service

These Terms of Service (“Terms”) govern your use of GovScanner, operated by Purple Ghost (ABN 60 923 627 375) (“we”, “us”, “our”). By creating an account or using our service, you agree to these Terms in accordance with the Electronic Transactions Act 1999 (WA).

1. Service description

GovScanner is an AI-powered government intelligence platform that monitors publicly available Western Australian government data sources. We scan, extract, and structure data using large language models (AI/LLM) and provide a web dashboard and API for searching, filtering, and querying government data.

1.1 Data sources

GovScanner currently monitors the following data sources:

  • WA Government Gazette
  • Parliamentary Hansard
  • Tabled Papers
  • Bills before Parliament
  • Acts of Parliament
  • Questions on Notice
  • Parliamentary Committee activity
  • Subsidiary legislation (regulations)
  • Explanatory Memoranda
  • Procurement and scheme notices

We aggregate, organise, and deliver information from these public sources. We do not create, verify, or endorse the underlying government data. We may add or remove data sources at any time with reasonable notice.

2. Information, not advice

All content delivered through GovScanner is for general informational purposes only. It is not legal advice, financial advice, compliance advice, or any other form of professional advisory service.

You should not rely solely on GovScanner to make business, legal, or financial decisions. Always consult qualified professionals for matters that could have material consequences for your business.

No client-advisor, solicitor-client, or fiduciary relationship is created between us and you by your use of the service.

3. Data accuracy

GovScanner uses artificial intelligence and large language models to extract and structure data from government publications. While we make reasonable efforts to ensure accuracy, AI-extracted data may contain errors, omissions, or inaccuracies. You acknowledge that:

  • Extracted data may not be complete or accurate in every instance.
  • Errors may arise from the original government source data, delays in government publication, technical issues in our processing, or changes in source data formats.
  • You should always verify information against the original source as published by the Government of Western Australia.
  • You should not rely solely on GovScanner for decisions with legal, financial, or compliance implications.

If you identify an error, please report it to us and we will investigate promptly.

4. Account terms

  • You must provide a valid email address to create an account.
  • You must be at least 18 years of age to use GovScanner.
  • Each account is for a single user. You are responsible for all activity under your account.
  • You must provide accurate and current information. You agree to update your details if they change.
  • You are responsible for maintaining the security of your account credentials.

5. Plans and pricing

Free tier

The Free tier includes 50 queries per month, up to 10 requests per minute, 6 months of historical data, and 1 API key. Dashboard access is included.

Pro - $29/month AUD

Pro includes 1,000 queries per month, up to 60 requests per minute, 12 months of historical data, and 1 API key. Includes a 14-day free trial, no card required.

Power - $99/month AUD

Power includes 6,000 queries per month, up to 120 requests per minute, 3 years of historical data, and 3 API keys.

Team - $299/month AUD

Team includes 25,000 queries per month, up to 300 requests per minute, full archive access, and unlimited API keys.

Annual plans are available at a discount (equivalent to 2 months free). All prices are in Australian Dollars (AUD) and are inclusive of GST where applicable. We reserve the right to change pricing with 30 days' notice to existing subscribers. Features and limits for each plan may change with 30 days' notice.

6. Payment, cancellation, and refunds

Payments are processed securely by Stripe. By subscribing, you authorise Stripe to charge your nominated payment method on a recurring monthly or annual basis.

  • Billing cycle: Subscriptions are billed monthly (or annually) from the date you subscribe.
  • Cancellation: You may cancel at any time via the billing portal. Your access continues until the end of your current billing period.
  • Failed payments: If a payment fails, we will attempt to process it again. After repeated failed attempts, we may downgrade your account to the Free plan.
  • Refunds: We do not generally provide refunds for partial billing periods. However, nothing in these Terms limits or excludes your rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). If the service has a major failure or fails to meet a consumer guarantee, you may be entitled to a refund or compensation regardless of this policy.

7. API terms

API access is included on all plans. The following terms apply:

  • API access is for your internal use only unless otherwise agreed in writing.
  • You must not share API keys or allow third parties to use your API access.
  • Rate limits apply per plan tier. We may adjust rate limits at our discretion to ensure fair usage.
  • We may suspend API access immediately if we detect abusive or excessive usage patterns.
  • API responses are subject to the same accuracy disclaimers as the dashboard (see Section 3).
  • You may not use the API to build a competing service or resell raw API data to third parties without our written consent.
  • We may modify or deprecate API endpoints with reasonable notice.

8. Consumer guarantees

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to:

  • Cancel your service contract; and
  • A refund for the unused portion of the service; or
  • Compensation for the drop in value of the service below the price paid.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time.

Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantees under the Australian Consumer Law.

9. Acceptable use

You agree not to:

  • Resell, redistribute, or sublicense GovScanner or its content without our prior written consent.
  • Use automated tools (bots, scrapers, etc.) to bulk-download or extract data from GovScanner beyond the scope of any authorised API access.
  • Attempt to reverse-engineer, decompile, or disassemble any part of the service.
  • Use the service for any unlawful purpose or in violation of any applicable law.
  • Interfere with or disrupt the service, servers, or networks connected to the service.
  • Create multiple Free tier accounts to circumvent usage limits.
  • Share account credentials with third parties.

10. Intellectual property

Government data sourced and presented through GovScanner remains subject to its original copyright and licensing terms (typically Crown copyright). GovScanner does not claim ownership of the underlying government content.

GovScanner's value lies in our AI-powered extraction, structuring, and intelligence technology. The software, algorithms, website design, branding, and all original content produced by GovScanner remain our intellectual property.

You retain ownership of any data you provide to us (preferences, saved searches). You grant us a licence to use this data solely for the purpose of delivering the service.

Platform data: GovScanner retains ownership of all aggregated, anonymised, and de-identified data derived from platform usage, including but not limited to: search trends, query patterns, category popularity, usage statistics, and derived analytics. We may use this data to develop and commercialise insights products, reports, and market intelligence offerings.

11. Limitation of liability

Subject to Section 8 (Consumer Guarantees) and to the maximum extent permitted by law:

  • GovScanner is provided “as is” and “as available” without warranties of any kind beyond those implied by the Australian Consumer Law.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.
  • We are not liable for any loss or damage arising from inaccurate data extraction or service interruptions.
  • We are not liable for any loss arising from your reliance on GovScanner as your sole source of government monitoring.
  • Our total aggregate liability to you for any claims arising from or related to these Terms or the service is limited to the amount you have paid us in the 12 months preceding the claim.

This limitation does not apply to liability that cannot be excluded or limited under the Australian Consumer Law, including liability for breach of consumer guarantees, fraud, or fraudulent misrepresentation.

12. Indemnification

You agree to indemnify and hold harmless Purple Ghost, its owner, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your use of the service in breach of these Terms.
  • Your violation of any applicable law or regulation.
  • Any third-party claim arising from your use of or reliance on GovScanner data.

This indemnity does not apply to the extent that the claim arises from our own negligence or breach of these Terms.

13. Service availability

We aim to provide reliable service but do not guarantee 100% uptime. GovScanner is provided on a “best efforts” basis. Our Service Level Commitment describes what we aim to deliver but is not contractually binding.

We may occasionally need to suspend or interrupt the service for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime where possible.

14. Force majeure

We are not liable for any failure or delay caused by circumstances beyond our reasonable control, including but not limited to: government source unavailability, internet outages, natural disasters, cyberattacks, pandemic, or changes in law.

15. Termination and suspension

By you: You may cancel your account at any time via the billing portal. Cancellation takes effect at the end of your current billing period.

By us: We may suspend or terminate your account immediately if:

  • You breach these Terms (particularly acceptable use provisions).
  • Your payment method fails and is not resolved within 7 days.
  • We are required to do so by law.
  • We reasonably believe your account is being used fraudulently.
  • We discontinue the service (with at least 90 days' notice).

We will provide reasonable notice before termination where possible, except in cases of serious breach or legal requirement. On termination, we will make your data available for export for 30 days, after which it may be deleted in accordance with our Privacy Policy.

16. Dispute resolution

If you have a dispute with us, we encourage you to contact us first at [email protected] so we can attempt to resolve it informally. We ask that you allow at least 30 days for informal resolution before commencing legal proceedings.

If informal resolution is unsuccessful, either party may refer the dispute to mediation in Perth, Western Australia, before commencing legal proceedings.

17. Changes to these Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice via email or a prominent notice on our website before the changes take effect.

Your continued use of GovScanner after the effective date of updated Terms constitutes your acceptance of the changes.

18. Governing law

These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Western Australia for any disputes arising under these Terms.

19. General

  • Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the service.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
  • No waiver: Our failure to enforce any right or provision is not a waiver of that right or provision.
  • Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights with notice to you.
