I refer to the minister’s answer to question 336 asked by me on Friday, 22 October 2004, in which the minister stated - Inspector Gillespie has been stood down from normal duty, pending the outcome of the findings of an independent review by senior counsel. (1) What abnormal duty is Inspector Gillespie performing? (2) Is the independent review by senior counsel separate from the review completed by the commissioner and reported to the State Solicitor’s Office for legal opinion? (3) If so, why have two reviews been necessary for a single set of evidence? Hon NICK GRIFFITHS

I thank the member for some notice of this question. The Minister for Police and Emergency Services has provided the following response - (1) The Police Service advises that Inspector Gillespie has been allocated restricted duties that do not involve contact with the public. (2)-(3) The Police Service advises that it conducted a review of the evidence, which was then forwarded to the State Solicitor’s Office for advice. The State Solicitor’s Office has now recommended that the police review be sent to the DPP for legal opinion.
(2) Is the independent review by senior counsel separate from the review completed by the commissioner and reported to the State Solicitor’s Office for legal opinion?
