I refer to the National Occupational Health and Safety Commission “Guidance Note on the Elimination of Environmental Tobacco Smoke in the Workplace”. This guidance note was endorsed by NOHSC at its sixty-sixth meeting on 15 October 2003. (1) Will the Western Australian Government be making the NOHSC “Guidance Note on the Elimination of Environmental Tobacco Smoke in the Workplace” mandatory by passing specific legislation or making amendments to the WA Occupational Safety and Health Act 1984? (1)-(2) Western Australia endorsed the NOHSC guidance note at the sixty-sixth meeting of NOHSC. The NOHSC guidance note will be used to assist with updating Western Australian guidance material and developing appropriate strategies for Western Australia. It is not appropriate to make this guidance note mandatory because the language and style of the document are designed to provide guidance, not prescription.
