I refer to the answer to question without notice 33 asked on Thursday, 31 March 2005. I am advised that Telstra BigPond Movies post hire movies in Western Australia, for viewing in Western Australia, after the client has selected a particular movie on the Internet and placed the hire request with Telstra BigPond Movies. (1) Is the Office of State Revenue aware of such hire transactions? (2) Is it confident that it is receiving the correct amount of stamp duty on such movie hire transactions? (3) What administrative procedures does the Office of State Revenue have in place to ensure it collects the appropriate amount of stamp duty from such movie hire transactions? Hon KIM CHANCE

(1)-(3) Secrecy provisions prevent the Commissioner of State Revenue from providing information regarding the affairs of specific taxpayers. However, he has advised that the new style of hiring businesses dealing with the hire of DVDs via the mail and Internet has been identified as an area of interest. A number of entities conducting hiring businesses in this manner have either recently been investigated or are currently under investigation. The Office of State Revenue has an active compliance program in place to ensure that businesses that are required to return stamp duty are in fact doing so.
