The clean up was carried out in line with an Environmental Management Plan approved by the school, the Department of Environmental Protection and the Health Department. The school sought reimbursement of costs incurred in obtaining independent environmental advice and the balance of costs for remediation it undertook separately which involved the installation of new playground equipment and site landscaping works. (4) Advice received at the time from the Crown Solicitor's Office indicated that, as the facts and legal issues were complex, it was a situation where the WAGRC and the State may wish to make an ex-gratia payment to compensate the school for costs it had incurred.
