With reference to all Metropolitan and Regional Prisons in Western Australia, I ask:
(a) what is the process for classifying and deciding which prisoners go to which prisons;
(b) who decides and how is the decision reached on approving prisoner transfers;
(c) what policies are in place for transporting prisoners to and from hospital and court that determine the security level of the prisoner, including if and how they will be physically constrained; and
(d) is the overall transport decision and authorisation made by the Department of Corrective Services or the transport contractor?

(a) The Department of Corrective Service's (the Department's) Adult Custodial Rule (ACR) 18 relates to the Assessment and Sentence Management of prisoners in Western Australia and provides clearly defined and consistent procedures for the initial and ongoing assessment and sentence management of prisoners within the WA prison system at both public and private facilities.
There are 3 (three) objective scoring instruments applied to determine security rating:
· MAP-Remand Checklist - to be applied to straight remand prisoners within five working days of initial receival into prison.
· MAP-Sentenced Checklist - to be applied to sentenced prisoners within five working days of initial receival or following sentencing.
· Classification Review Checklist - to be applied at six or twelve monthly reviews of the Individual Management Plan (IMP) or if a change of circumstances warrants a review of the prisoner's IMP.
The Initial Security Rating (ISR) scoring instrument assists in assessing the appropriate security rating to increase consistency across prisoner classification and is a component of the MAP. It is intended for use by assessing officers (prison officers) at the initial receiving prison and during the development of Initial IMPs. Subsequent reviews, which are conducted by the report writer, will determine a prisoner's security rating by the application of a Classification Review Checklist, which identifies a prisoner's Classification Review Score.
If the ISR or Classification Review Score ranges between 0 - 6, the prisoner will be deemed minimum security, 7 - 13 medium security and 14 and over, maximum security. These security ratings will then determine the prison placement options for individual prisoners. There are also provisions for override of the classification review score when other factors need to be considered (e.g. safety issues, treatment requirements, health issues, etc).
Where practicable, prisoners are placed as close as possible to family, friends and/or significant others in order to promote family, community and social support. However if the prisoner's security rating prevents placement in a prison close to their support networks, they can apply for a temporary transfer to facilitate visits. Health issues and access to treatment intervention programs may also impact on the placement of a prisoner at a preferred facility.
(b) As a result of the scoring outcomes of the checklist completed, the prisoner's security rating and subsequent transfer is approved by the following:
· A prisoner serving up to and including three years requires approval by the Manager of Assessments (Hakea Prison)/Assistant Superintendent/Acacia equivalent.
· A prisoner serving more than three years requires approval by the Designated Superintendent/Director Acacia.
· Prisoners serving Indeterminate and Life sentences require approval by the Designated Superintendent/Director Acacia.
· Prisoners serving Strict Security Life, Strict/Safe Custody sentences require approval by the Designated Superintendent/Director Acacia, with Executive Council approval for transfer if required.
· In certain circumstances the Commissioner will override a recommendation.
(c) The prisoner's security rating does not change when they are transported to hospital or court. However, the following policies determine whether prisoners are required to be restrained during transportation:
The chief executive officer rule (in accordance with clause 32 of the
Court Security & Custodial Services (CS&CS) Act 1999
), Request to Move a Person in Custody provides that all requests for the movement of persons in custody shall include as a minimum any information relating the management of the person's security. This information is provided by each individual prison for prisoners being transported to hospitals and courts.
In accordance with the CS&CS Contract (Schedule 6 Clause 7) all secure persons in Serco custody for the purpose of lockup clearances, inter prison and court transfers, medical and funeral escorts, hospital sits and other approved escorts are to be physically restrained unless specifically directed otherwise. Serco has in place approved (by the Department) Operational Instructions that provide the operational details for their officers to follow when persons in custody are in their charge, including security management and the use of restraints.
(d) The decision to transport a prisoner is made by the Department who issue the Contractor with a movement request.
