CODE AMENDMENT BILL 2008 — SENTENCING PROVISIONS
1189. Hon SAMANTHA ROWE to the
Attorney General:
I refer to correspondence from former Attorney General
Christian Porter to the Director of Public Prosecutions sent after the passage
of the Criminal Code Amendment Bill 2008 through Parliament.
(1) Will the
Attorney General table any such correspondence in relation to sentencing
provisions associated with the ''assaulting a public officer''
provisions of the bill?
(2) If no to (1), why not?

I thank the honourable member for some notice of this
question.

A search undertaken within the time available has not located correspondence
from then Attorney General Porter to the Director of Public Prosecutions around
the time the Criminal Code Amendment Bill 2008 was assented to on 21 September
2009. I am happy to provide the member with a response if she has a specific
question about the ''sentencing provisions associated with the 'assaulting
a public officer' provisions'' of this legislation.
