Minister for Commerce:
I refer to question without notice 228 that I asked in this
place on Tuesday, 17 March. For each of the 15 complaints that the Building
Commission received against Benchmark Designer Homes Pty Ltd, what was the
outcome and what, if any, penalties were applied?

I thank the honourable member for some notice of this
question.
In 2015, there has been one disciplinary complaint, which is the
subject of a continuing investigation. In 2014, there were six building service
complaints. Four are ongoing and two were finalised in the State Administrative
Tribunal, resulting in orders being issued against the builder. There was one
disciplinary complaint, which was refused by the Building Commissioner. In
2013, there were two disciplinary complaints. One was refused by the Building
Commissioner and one was dismissed by the Building Commissioner. There was one
home building work contract complaint, which was dismissed by the State
Administrative Tribunal. In 2012, there were four building service complaints,
which all resulted in building remedy orders being issued by the Building Commissioner.
