minister representing the Minister for Local Government:
I refer to the Minister for Local Government's recent
decision to dismiss the City of Canning council.
(1) Why did it take 64 days to decide to announce the
dismissal?
(2) Given that
the full Local Government Advisory Board recommendations will not be released
until November —
(a) why was Commissioner Reynolds
dismissed at the same time as the council; and
(b) why does the City of Canning
now need three commissioners?
(3) What are the terms of appointment and roles of the three
commissioners?
(4) Has an
allowance been made in the state budget or the City of Canning's budget
for the new commissioners' salaries; and, if not, who will pay the
salaries?

I thank the member for some notice of the question.
(1) Under the
Local Government Act 1995, the Minister for Local Government is required to
provide 35 days to the local government concerned, and to each suspended
elected member, to respond to the recommendations of the panel inquiry's
report to dismiss the council. After receipt of submissions and advice, the
minister gave the matter further consideration before he recommended to the
Governor that the council be dismissed.
(2) Commissioner
Reynolds' term ended with the dismissal of the council. After
consultation with the community, the Minister for Local Government found that
it wanted more than one commissioner to represent it, especially in this period
of structural change.
(3) The
commissioners have been appointed from 17 September 2014, with an election to
be held to elect a new council on Saturday, 17 October 2015.
In accordance with section 2.40(2)
of the Local Government Act 1995, the joint commissioners are to exercise the
powers and discharge the duties of the council of the local government jointly.
In addition, under section 2.40(2) of the act, the chairperson of commissioners
is to exercise the powers and duties of the mayor or president.
(4) The City
of Canning is responsible for payment of remuneration to the commissioners, as
it would be for its elected members.
