I refer to a letter dated August 29 2005, Departmental reference ‘ceo 1035/05’ and ‘ceo 1090/05’ addressed to Mr L A Mills -
(1) Will the Department of Environment (DoE) impose a licence condition on the proponents licence when it is reissued on or before September 30 2005 to ensure that emissions of saline, alkaline or cyanide constituents are retained, contained within the premises of the surveyed boundaries of Mining Lease 26/383 to prevent or control pollution or environmental harm from arising on Prospecting Licence 26/3126?
(2) If no to (1), why not?
(3) Can the Minister indicate the specific date on which Mining Lease 28/383 was surveyed?
(4) If no to (3), why not?

The Minister for the Environment; Science has provided the following response: (1) The Department of Environment has a condition on the existing license that states: "The licensee shall manage the storage of all matter containing saline or alkaline constituents within holding facilities in a manner, which prevents pollution." Following the Minister for the Environments' Appeal Determination 244 to 250 of 2004 (dated 19 August 2005), the Department of Environment intends to add the word "cyanide" to this condition. This condition requires KCGM to manage this matter to ensure it doesn't cause pollution either on or off Mining Lease 26/383. (2) Not applicable. (3) It is presumed the question refers to Mining Lease 26/383. The Department of Environment does not issue Mining Leases. This is the responsibility of the Department of Industry and Resources and therefore the question needs to be directed to the Minister for State Development. (4) Not applicable.
