2. Hon Colin de Grussa to the Minister for Fisheries :
I refer to the state
government's decision not to proceed with the implementation of the Aquatic Resources Management Act 2016 and the
acknowledged flaws in the Fishing and Related
Industries Compensation (Marine Reserves) Act 1997 .
(1) Is there currently a proposal to review the
FRICMA?
(2) If yes to (1):
(a) what is the timeframe for the review; and
(b) will the minister provide a commitment that
changes to the FRICMA will be in place in time to be accessed by commercial
fishing businesses affected by the South Coast Marine Park?
(3) If no to (1), is it intended that commercial
fishing businesses affected by the South Coast Marine Park will be required to
access compensation through the FRICMA in its current form, given its
acknowledged flaws?

(1)–(3) Compensation processes for
commercial fishing businesses impacted by the creation of marine parks can be
delivered via the Fishing and Related Industries
Compensation (Marine Reserves) Act 1997 and the Fisheries Adjustment Schemes Act 1987 . A working
group is involved in recommending valuation methodologies and improvements to
compensation processes to government to increase transparency and information
for impacted commercial fishers. The Department of Primary Industries and
Regional Development is working with the Western Australian Fishing Industry
Council to develop more transparent and consistent compensation processes which
deliver greater certainty and are less onerous, more timely and more equitable.
