Further to my question on notice No. 5031 of 22 November 2011 and given no payments were made in connection with the second round of application for Mackerel permits, I ask -
(1) Was the total allowable catch breached due to the second round?
(2) If yes to (1), by how much?
(3) Given permit holders purchased additional units in the period between the original allocation and the second round allocations, did any permit holders have their units or allowable catch reduced?
(4) If yes to (3), was any form of compensation given?
(5) If yes to (4), what type of compensation was given?
(6) If no to (4), why not?

(3) Permit holders did not have their number of units reduced. Unit values were adjusted to accommodate the units allocated to the second round permit holders within the Total Allowable Commercial Catch (TACC) set for the fishery.

(6) A number of Fishing Boat Licence (FBL) holders met the access criteria based on catch history but did not submit an application for a permit within the original application period. The application period was reopened to provide those FBL holders with an opportunity to apply for a permit. Following the second round of applications, unit values were adjusted to accommodate the units allocated to the second round permit holders within the TACC set for the fishery. Accommodating the additional permit holders by increasing the TACC would have posed an increased risk to sustainability. The resulting unit values reflected the level at which they would have been originally set had all permits been granted following the original application period. Compensation was considered not appropriate in these circumstances.
