Mr. McGowan questions why a system allowing direct payment to subcontractors exists on one project (Perth Stadium) but not others, while the Minister for Finance explains that liquidation prevents direct payment due to Commonwealth law.

PERTH STADIUM — SUBCONTRACTOR PAYMENTS
476. Mr M. McGOWAN to the Minister for Finance:
I ask a supplementary question. It
does not matter how much the contract is worth. Under one project, there is a system
in place whereby the state can pay the affected subcontractor and then recover the
amount as a matter of course from the head contractor. Why is the minister
implementing it on one project and not others?

In this particular case, the
contractor has gone into liquidation. Once a contractor has gone into liquidation,
we cannot pay the subcontractor because the liquidator or the administrator is
in charge of distributing the money under commonwealth laws.
