I refer to a pamphlet dated August 2003 titled ‘Environmental Harm a new offence under the
Environmental Protection Amendment Bill 2002
’, a letter which I understand is dated August 29 2005 signed by Acting Director General, Department of Environment titled ‘Various Issues relating to Kalgoorlie Consolidated Gold Mines (KCGM) Works Approval Application for the raise of the Fimiston I Tailings storage facility’ and the ‘Environmental Audit and review of Cockburn Cement Ltd Operations at Munster’, report number 1 dated July 2002 -
(1) Does the Minister agree with that all licence conditions on all premises are established by the Department with the sole purpose of preventing, controlling and abating pollution?
(2) If no to (2), why not?
(3) If yes to (1), can the Minister explain why?
(4) Does the Minister agree that when a breach of condition occurs, such as an exceedance of a discharge limit, there is the possibility that pollution may have been caused and that further investigation should be undertaken to determine the effect?
(5) If no to (4), why not?
(6) If yes to (4), can the Minister state why?
(7) Can the Minister confirm that part of the Environmental audit report dated July 2002 states ‘For whatever reasons, DEWCP’s role in relation to regulating CCL appears to have generally been reactive, largely dominated by responding to complaints of specific incidents, rather than being proactive such as through the review of changed circumstances at and surrounding the operation, company monitoring of its environmental performance and revision of licence conditions to more effectively control discharges and emissions’?
(8) Can the Minister state what, if anything, has the Department learned from the Cockburn Cement audit findings dated July 2002 to make drastic improvements to all licensed premises within the state of Western Australia so as the environment and the community is not exposed to the Department’s incompetence?
(9) If no to (8), why not?
(10) Does the Minister agree with all the findings of the Audit report dated July 2002?
(11) If no to (10), will the Minister state specifically which findings from the report and the justification for each?

(2) Section 62 and 62A of the Environmental Protection Act 1986 defines the types of conditions that can be imposed on a license. In particular Section 62 (1) states: " A works approval or license may be granted subject to such conditions as the CEO considers to be necessary or convenient for the purpose of this Act relating to the prevention, control, abatement or mitigation of pollution or environmental harm " (3) Not applicable.
