(1) Two. (2) The appeal against the level of assessment was dismissed; the appeal against the Environmental Protection Authority’s (EPA) Report and Recommendations was upheld in part. (3) The two appeals were not dismissed. The Ministerial Conditions recommended by the EPA were amended to require: · the Validation Report be reviewed and approved on advice of the DoE’s Land and Water Quality Branch · the final Coal Dam Remediation Plan is approved on advice from the DoE’s Land and Water Quality Branch · the Air Quality Management Plan is approved by the DoE’s Air Quality Management Branch · a complaints register be prepared and implemented · a Stakeholder Consultation Strategy be prepared and implemented. (4) The Ministerial Conditions were issued following determination of the appeals.
