I refer to the Ministerial Council for Tertiary Education and Employment (MCTEE) meeting in Perth on 9 June 2010, where Ministers agreed to stronger standards for Registered Training providers, delivering training qualifications under the Australian Quality Training Framework, and I ask -
(1) What are the stronger standards?
(2) Why was it decided that stronger standards are needed?
(3) What are the transitional arrangements that will apply to Registered Training providers, who have not previously had to comply with requirements under the Australian Qualifications Framework Council?

(1) The changes to the Australian Quality Training Framework (AQTF) do not represent a change in policy, but rather a strengthening of the Framework.
Key changes to the AQTF include:
- Clear separation between the requirements for initial and ongoing registration to ensure that assessment of critical quality aspects of providers operations are assured on entry to the marketplace and requirements specific to deployment are addressed for continuing registration.
- Introduction of a fit and proper person test for senior officers, directors or substantial shareholders who are in a position to influence the management of the organisation.
- Requirements to demonstrate business planning and continuing viability, including financial viability; fee disclosure to students; and protection of student fees paid in advance.
- Demonstration to the registering body on request that the provider is/will be financially viable at all times during its period of registration.
- Student records management systems that have the capacity to provide Australian Vocational Education and Training Management Information System Standards (AVETMISS) compliant data; support the proposed unique student identifier number; and ability to provide returns of client results on a regular basis to the registering body.
- Additional requirement that trainers and assessors can demonstrate current industry skills directly relevant to training/assessment.
The
National Guideline for Risk Management
has been strengthened to further align it with the Australian Standard for Risk Management (AS/NZS ISO 31000:2900)

At its 7 December 2009 meeting, COAG agreed to amendments to the AQTF that will strengthen conditions and standards for initial registration of new training providers entering the market and conditions for continuing registration of ongoing providers, with conditions audited at initial registration and each renewal of registration in accordance with risk management guidelines.
COAG agreed to amend the Australian Quality Training Framework (AQTF) to strengthen the regulatory requirements underpinning the VET sector where weaknesses had become apparent in the international education sector and to provide better consumer protection for students undertaking VET in Australia

It is assumed that the question is intended to relate to the transition arrangements for compliance with the AQTF.
All RTOs and organisations applying for registration were required to comply with all AQTF conditions and standards from 1 July 2010 with the exception of the compliance with the requirements relating to collection of student fees in advance, requirements for a unique student identifier and provision of AVETMISS compliant data. Compliance with these requirements will not be required until 3 January 2011.
It should be noted that the requirement to protect student fees paid in advance and to provide student results data are already requirements for Western Australian providers.
