(1)-(2) The Maximum Wholesale Price (MWP) is a price determined by the Prices Commissioner at the Department of Consumer and Employment Protection (DOCEP) that applies to spot purchases of unleaded petrol at the terminal gate of controlled terminals. A retailer that is already party to a wholesale supply contract is not eligible to purchase at the MWP.
DOCEP has been notified of three genuine attempts to purchase at the MWP and that on each of the three occasions supply was refused. DOCEP has commenced one prosecution against Mobil and two against BP for alleged failure or refusal to supply at the MWP. All three prosecutions were heard in court on 16 October 2002 and the next appearances will be on 18 December 2002.
DOCEP is not aware of any other genuine attempts to purchase at the MWP.
(3) The MWP only applies at controlled terminals. Currently all controlled terminals are located in the Perth metropolitan area. The MWP is to be replaced by a Terminal Gate Price which will apply to all terminals throughout the state.
