❓ Hon. Norman Moore questions the Premier's refusal to table Crown Solicitor's advice on the Mauds Landing proposal, arguing that selective disclosure to journalists breaches convention and undermines parliamentary accountability. The response defends the disclosure as a response to unfounded attacks and offers to table the advice while demanding transparency regarding Moore's own advice.

I refer the Premier to the report of the WA Inc royal commission, which stated that the accountability of government and of the administrative arms of government is at the heart of the matter and that our inherited system of representative democracy has traditionally given the Parliament the central role in securing the Executive’s accountability to the public. In light of that, I also refer the Premier to his refusal to provide the Parliament with the Crown Solicitor’s advice about the Mauds Landing proposal on the grounds of past convention, as stated in his reply to my question without notice 1298. (1) Does the Premier acknowledge that his willingness to allow some journalists to see the advice has breached that convention by waiving professional privilege, and thus there is no reason for denying the Parliament an opportunity to see what the media has seen? (2) Will the Premier demonstrate his commitment to parliamentary accountability by tabling the Crown Solicitor’s advice shown to the journalists or at least allowing interested members to see it; and if not, why not? Hon Tom Stephens: When are you going to show us your advice? Hon NORMAN MOORE: I have read my advice to the House, clod. Hon Tom Stephens: Who signed it? Hon NORMAN MOORE: I did. Hon Tom Stephens: Your speech; your legal advice. The PRESIDENT: Order! The Minister for Local Government and Regional Development is not the Leader of the House, who has the call. Hon KIM CHANCE

Thank you, Mr President, for that advice. (1)-(2) The sustained attack by Hon Norman Moore on the credibility of the environmental assessment procedure associated with the Coral Coast Marina Development Pty Ltd project, which time and again has proved to be unfounded, prompted a public disclosure of the legal advice that confirms the legality of the delegation of decision making. Hon Norman Moore: Public disclosure! Hon KIM CHANCE: Yes. Hon Norman Moore: To whom? Hon KIM CHANCE: Wait; the good bit is coming. In the interests of putting an end to this farce, which is costing taxpayers thousands of dollars, I am prepared to table the advice - Hon Norman Moore: Hurray! About bloody time. Hon KIM CHANCE: Hang on - Hon Tom Stephens: Are you going to show us yours? Who wrote it? Hon Norman Moore: You can assess it as much as you like. It is irrelevant. Hon Tom Stephens: It is not irrelevant. You are irrelevant. The PRESIDENT: Order! Hon KIM CHANCE: I now request, as the Premier has already done, that the Leader of the Opposition place on the record who commissioned his advice, who paid for his advice and who provided his so-called advice. Government members: Hear, hear! Hon Norman Moore: I will tell you everything I want to tell you during members’ statements this afternoon. Hon Ljiljanna Ravlich: Will you provide it? Hon Norman Moore: I do not answer questions in question time; you do.

Hon Norman Moore: I do not answer questions in question time; you do.
