I refer to the Children and Community Services Regulations 2006 and the effect that these regulations will have on some crèche facilities in regional Western Australia, and I ask -
(1) How will the Minister act to address the unworkable aspects of the regulations in regard to the rule that limits the ability of the crèche to legally operate unless parents are within 50 metres of their children?
(2) Will the Minister act to give flexibility to the time children are permitted to attend country crèches to allow parents, such as those at the Narrogin Golf Club, to have access to crèche facilities for events that may extend beyond a three-hour time limit?
(3) Is the Minister willing to compromise to allow country crèches the flexibility to operate as a “care that is not a child care” to ensure rural Western Australians still have this facility available to them?

2-3. The principle of crèche regulation under the Children and Community Services Act 2004 is that crèches may operate without a licence provided that parents are available to attend to their child's immediate physical needs. The regulations also stipulate other criteria which must be met if the crèche is to operate without a licence and these standards concern time limits on care sessions, the minimum age of children, and the age and first aid qualifications of carers. Enquiries about specific events involving crèches should be directed to the Child Care Licensing and Standards Unit of the Department for Community Development.
