I refer to the board of Synergy, specifically to the legislative provisions in the Act which provides the board must be comprised of not less than four, and not more than eight, directors appointed by the Governor of Western Australia on the nomination of the Energy Minister, and that the Minister, in making nominations, is required to consult with the board and ask: (a) has the Minister sought legal advice from the State Solicitor’s Office, or any other legal body, with respect to the appointment of board members when the current board of two members does not meet the statutory requirements to appoint further members, and; (b) if yes to (a), when did the Minister receive this advice; and (c) if no to (a), why not?
