I thank the member for some notice of this question. There are two avenues of early release for deportation for foreign nationals sentenced under state legislation - (a) If the prisoner’s sentence includes a provision for release on parole and an order for deportation is in force, the Parole Board may make an order for the prisoner’s release for the purpose of deportation. (b) The Governor acting in Executive Council may order that the balance of any state sentence be remitted. With regard to foreign nationals sentenced under federal legislation, the date of release for deportation is determined by the appropriate commonwealth authority.
