BOARD — WAR GRAVES
338. Hon Dr BRIAN WALKER to the minister representing the
Minister for Local Government:
I
thank the minister for her response to my question without notice 227 of 20
March 2024 regarding the retention of war
graves as part of the Karrakatta Cemetery renewal policy. In that response, she
made reference to a memorandum of understanding between the Metropolitan
Cemeteries Board and the Office of Australian War Graves.
(1) Is that
memorandum of understanding legally binding upon either or both parties?
(2) Which body
has the final say under the memorandum when it comes to deciding whether a war
grave is retained or not?

I thank the honourable member for
some notice of the question. The following response has been provided by the
Minister for Local Government.
(1) Please refer
to Legislative Council standing order 105(l)(b).
(2) The Metropolitan Cemeteries Board advises that it
works closely with the Office of Australian War Graves , guided by the
provisions of the memorandum of understanding. Since the MOU was signed,
official war grave monuments are retained in their original position and are
not affected by renewal programs.
