(1) Noting that the Western Australian Legislation website
publishes ratified State Agreements in the form of schedules to the principal
Act whereby schedule 1 shows the original agreement and subsequent schedules
show each supplementary agreement in the order it was ratified (rather than
publishing the State agreement in its complete, consolidated, current form), I
refer to section 81 of the
Financial
Management Act 2006,
and I ask:
(a) will the Minister please table a complete, consolidated, current version of the
North West Gas Development (Woodside) Agreement 1979
;
(b) if no to (a), why not;
(c) does
the State Agreement include the Second Variation Agreement referred to in
clause 2;
(d) if no to (c):
(i) why not;
(ii) will the Minister please table a complete consolidated current version of it; and
(iii) if no to (d)(ii), why not;
(e) will the Minister please provide separate copies of any
variations to the Agreement that have been made since commencement that do not
appear on the Western Australian Legislation website as a schedule;
(f) if no to (e), why not;
(g) will the Minister please identify currently in what manner the State Agreement can be varied;
(h) if no to (g), why not;
(i) regarding the joint venturers’
ability to provide notice seeking a further extension of term, will the Minister please clarify how long that
extension can be, 12 years or 21
years; and
(j) if no to (i), why not?
(2) I refer to the water supply agreement that the joint venturers and the Water Corporation have entered into in accordance with the
Water Corporation’s major consumers framework, and ask:
(a) will the Minister please table a copy of the Water Supply Agreement dated 2 August 2019;
(b) if no to (a), why not;
(c) will the Minister provide details of the effective changes that will be made to the current water supply arrangement; and
(d) if no to (c), why not?
(3) I refer to the statement found in the Second Reading Speech on Thursday, 26 September 2019, "This replaces the existing rights and obligations of the State, including the Water Corporation, and the joint venturers under the State Agreement on water supply, and modernises the joint venturers’ water supply arrangements in line with other resource companies operating in the Pilbara", and ask:
(a) will the Minister please list the other resource companies;
(b) are the water supply arrangements contained in the other resource companies State Agreements or in a separate agreement, as here;
(c) will the Minister please provide details of how this Water Supply Agreement can be varied; and
(d) if no to (c), why not?
