The
Criminal Law (Mentally Impaired Accused) Act 1996
(WA) (CLMIA Act) is currently under review; the review commenced under the previous government. On 30 April 2007 the former government approved the drafting of a Bill to repeal the CLMIA Act. In August 2009 I approved further work being undertaken on the draft Bill. It is currently anticipated that this work should be finalised by the end of 2011.

Yes. The review process has involved extensive consultation with stakeholders from the mental health and legal sectors, including members of the judiciary and forensic practitioners. Consultation with key stakeholders will continue as the draft Bill is further refined.
