102. Mr J.N. HYDE to the Minister for Planning:
I refer again to the minister's financial interest in
a property at Waratah Avenue, Dalkeith opposite the site of a development
proposal directly affected by his ministerial decision.
(1) Having
denied that the he has a conflict of interest, will the minister now admit that
he has an actual or perceived conflict of interest as referred to in the
Ministerial Code of Conduct?
(2) If the
minister believes that he has no actual or perceived conflict of interest, what
is his interpretation of the term ''perceived conflict'' referred
to in the Ministerial Code of Conduct?
(3) Will the
minister now admit that it was improper on his part not to disclose to the
Premier the potential for an actual or perceived conflict of interest in this
matter?

I accept that the member for Perth makes that assertion, but I do certainly
maintain that there is no conflict of interest. The decision that I made on the
recommendation of the Western Australian Planning Commission following due
assessment by the Department of Planning officers over a period of time in relation
to the planning scheme amendment was entirely in accordance with the
recommendation made to me by the WA Planning Commission.

Also I point out that my ownership of a particular property was declared in the
register of members' interests in September 2010. The first advice I
received in relation to the planning scheme amendment and the formalities
involved in the planning scheme amendment was in May 2011.

Mr J.H.D. DAY : I
accept that the member asserts that that is the case. Whether there is an
actual conflict of interest, I think, is the essential point.
The actions that I have taken in this matter have at all
times been guided by the public interest and by the recommendations of the WA
Planning Commission, as I said, following due assessment by Department of
Planning officers.

I pointed out yesterday, the decision that was made—as I said, on the
recommendation of the Planning Commission—was also in accordance with
the planning framework for the Perth metropolitan area, which is well laid out
in the public arena in ''Directions 2031'', which refers to the growing
population and changing demographics in the Perth metropolitan area. In
relation to the details of the issue, I have sought advice from the cabinet
secretary regarding the appropriateness of my actions and the decision that I
made.
