MENTAL HEALTH ACT — MEDICAL PRACTITIONERS
898. Hon LJILJANNA RAVLICH to the Attorney General:
(1) When did
the State Solicitor's Office advise the Minister for Mental Health that
the operation of the Mental Health Act precludes a medical practitioner with
limited registration from performing the functions of a psychiatrist under the
Mental Health Act and that only those psychiatrists with specialist registration
are able to perform these functions?
(2) Why did the State Solicitor's Office provide this
advice?
(3) What is
the current legal position of a medical practitioner who holds only limited
registration in performing the functions of a psychiatrist under the Mental
Health Act?
(4) What is
the legal position of patients who have been treated by a medical practitioner
with only limited registration?

I do not have a record of that
question. The member says some notice of it was given.
Hon Ljiljanna Ravlich : Yes, it was.
Hon MICHAEL MISCHIN : Can the member tell me when?
Hon Ljiljanna Ravlich : I understand it was sent yesterday
and it should have gone back in today.
Hon MICHAEL MISCHIN : I do not have that answer. I will
see if something turns up during the course of question time, in which case I
will respond; otherwise I will deal with it tomorrow.
