126. Hon SALLY TALBOT to the
Minister for Housing:
I refer to South Hedland's Osprey Village and
Fleetwood Corporation's statement yesterday that should the parties not
be able to satisfactorily agree on terms for a formal agreement, Fleetwood
would be entitled to receive a capital payout from the government.
(1) What is
the amount of that capital payout?
(2) Is
Fleetwood entitled to the payout under the terms of any current interim
agreement or arrangement as claimed?
(3) Would Fleetwood
be required to return all or any portion of licence fees already paid to it in
the event formal agreement is not reached; and
(a) if yes to
(3), what is that amount; and
(b) if no to
(3), why not?
(4) Did
Treasury, the State Solicitor's Office or any legal officer review the
interim agreement or any other contractual arrangement in place with Fleetwood?
(5) Will the
minister table the interim agreement with Fleetwood; and, if not, why not?

payment for Fleetwood's investment to finance and construct 295
dwellings and project manage all civil infrastructure works.
(3) No.
(a) Not
applicable.
(b) The
licence fee is paid in accordance with the licence and interim agreement of
February 2014. This is a temporary arrangement while negotiations are
progressed around long-term formal agreements. There have been no changes to
the management and associated fee arrangements since 1 November 2014.
(4) Yes.
(5) No. The
interim agreement is commercial-in-confidence and disclosure may impact
commercial negotiations with Fleetwood around the terms of a formal agreement.
