I refer to the Barrick Kanowna Raleigh underground operations and question on notice No. 2275, 20 April 2010, and ask -
(1) In light of the answer provided in part (14) for question on notice No. 2275, can the Minister state specifically why the Department of Mines and Petroleum (DMP) inspectors, made an inspection of the underground crib room, the surface change rooms and surface crib rooms at the Raleigh mine site on 8 March 2010?
(2) If no to (1), why not?
(3) Can the Minister state how many inspections have taken place by DMP inspectors, in the last two years at the Raleigh mine site, -
(a) of the underground crib room;
(b) all three surface change rooms
(c) the surface crib room;
(d) on what specific dates these inspections occurred;
(e) what breaches of the
Mines Safety and Inspection Act 1994 and Regulations 1995
, were identified; and
(f) what enforcement action, was imposed by the DMP inspectors for those breaches?
(4) If no to (3), why not?
(5) In light of the answer provided in part (14), for question on notice No. 2275, can the Minister state whether or not, the DMP inspectors checked in the Safety Toolbox Meeting Minutes Book, to see how many concerns had been raised by the employees with management at Raleigh mine, concerning, -
(a) the underground crib room;
(b) the surface change rooms; and
(c) the surface cribroom at the mine in the past 24 months?
(6) If no to (5), why not?
(7) If yes to (5), -
(a) will the Minister state how many complaints were received;
(b) specifically what each complaint was;
(c) what the course of action for management was for each complaint; and
(d) how long each complaint took to resolve?
(8) With respect to (5), will the Minister expediently require an investigation into this matter, to ensure that the safety committee at that mine is operating effectively?
(9) If no to (8), why not?
(10) In light of the answer provided in part (14), in question on notice No. 2275, were any breaches of Regulations 7.13, 7.14, 7.17, 7.19 or any other section the
Mines Safety and Inspection Act 1994 and Regulations 1995
identified, and if so, what specifically were those breaches?
(11) With respect to (1) and (5), -
(a) can the Minister state what breaches if any of the
Mines Safety and Inspection Act 1994 and Regulations 1995
were identified;
(b) what enforcement action, if any, was imposed by the DMP inspectors for those breaches;
(c) what are the maximum penalties for those breaches; and
(d) will the resident manager, or any other responsible person at the Barrick Kanowna Raleigh mine, be prosecuted for any breaches of the
Mines Safety and Inspection Act 1994 and Regulations 1995

(1) The Senior Inspector of Mines received a report from Hon Helen Bullock MLC, Member for Mining and Pastoral Region. The report alleged a number of poor conditions at the Raleigh Mine. As a response the District Inspector of Mines inspected the areas of concern and equipment involved on 8 March 2010.
(2) Not applicable
(3) (a)-(f) No
(4) Specific records regarding inspections of these areas are not kept. These areas may be inspected by the Department of Mines and Petroleum inspectors as part of a general inspection of the mine.

(a)-(c) The Department of Mines and Petroleum inspectors did not check the Safety Toolbox Meeting Minutes Book.
(6) Employees' Inspectors of Mines attend some of the safety meetings held by each crew. No complaints were received from employees that would have warranted a check of those minutes.

(9) The minutes referred to in Question 5 are the minutes of each crew's individual safety meeting held once during the crew's roster.  They are not the minutes of meetings of the Safety and Health Committee as referred to in the
Mines Safety and Inspection Act 1994
. As such they do not provide an indication of how effectively the Safety and Health Committee is functioning.

and Regulations 1995 were identified.

(c) Regulation 17.1 sets the General Penalty levels for breaches of the Regulations mentioned in part (10) of the question. The maximum penalty in the case of a Corporation for the first offence is $50 000.

and Regulations 1995 relating to these matters were observed during the inspection on 8 March 2010.
