(1) Can the
Minister confirm that Class V waste is being accepted by the Eastern
Metropolitan Regional Council (EMRC) at Red Hill Landfill: (a) if yes for how long has this been the case;
and (b) if not, why not? (2) Is the Minister aware that the EMRC is
advertising to the public on its website that it accepts Class V waste and
lists prices for that service? (3) Can the
Minister confirm the EMRC Red Hill landfill is not licensed to accept class V
waste under the Department of Environment Regulation licensing
system? (4) If yes to (3), why has the
Minister taken no action to prevent class V waste dumping at Red
Hill? (5) Can the Minister confirm that
Class V waste is the most toxic, intractable waste in the state that can only
legally be disposed of at the remote Mt Walton entombment site: (a) if not, why not; and (b) if yes, why is it being accepted at Red
Hill?

(1) Yes
(a) The Eastern Metropolitan Regional Council (EMRC) has advised the Department of Environment Regulation (DER) that the practice of accepting Class V material for immobilisation or encapsulation and disposal at its Class IV cell commenced in 2004, with the latest load accepted in 2012.
(b) Not applicable
(2) Yes
(3) By virtue of the EMRC's Red Hill facility being licensed under the
Environmental Protection Act 1986
as a Class IV landfill, it is authorised to accept and bury immobilised or encapsulated Class V waste.  This is in accordance with the
Landfill Waste Classification and Waste Definitions 1996
[as amended].
(4) Not applicable
(5) Class V waste is any solid waste containing chemical contaminants exceeding the leachable or total concentration limits for Class IV classification as set out in the
Landfill Waste Classifications and Waste Definitions 1996
[as amended].  Class V wastes can range from contaminated soils to wastes resulting from industrial processes.
Class V waste can be treated, immobilised or encapsulated to meet Class IV landfill acceptance criteria. The chemical contaminants in some Class V waste can also be destroyed or treated (removed) using other technologies (for example, some heavily contaminated soil can be successfully remediated through biological processes or thermal treatment, and the cleaned soil safely re-used).
Class V waste that cannot or that has not been treated, immobilised or encapsulated to meet Class IV landfill acceptance criteria can only be buried in Western Australia at Mt Walton.

Landfill Waste Classifications and Waste Definitions 1996
