Minister for Early Childhood:
I refer to the
regulation of family day care educators.
(1) Is it the case that family day care educators
must provide both a national police clearance and a working with children check
(WWCC) for every resident in their home irrespective of whether the resident is
working with children?
(2) If yes to (1), will the minister table the
policy or guideline that sets out this obligation?
(3) If no to (1), is the minister aware that at
least one service provider is requiring this, notwithstanding that it is not
possible to obtain a WWCC if a person is not undertaking or seeking to
undertake child-related work?

(1) The Education and Care Services National
Regulations require residents of a family day care educator's home to hold
either a working with children check (WWCC), a national police clearance or a
current teacher registration. That is regulation 163(4).
(2) The requirements are set out in the Education
and Care Services National Regulations, which are publicly available.
(3) Not applicable.
