CHILDREN AND COMMUNITY SERVICES REGULATIONS 2006 - CRECHES
I refer to the Children and Community Services Regulations 2006, and in particular to part 6, section 23, under the heading “Care that is not a child care service”. Clause 23(2) states that care provided to a child is excluded from the application of section 198(1) of the act if - (b) a parent or other relative of the child is not more than 50 metres from the place where the care is provided. Does “the place” mean the actual place where the child is cared for, which would mean the creche, or does “the place” mean the building in which the creche is located? Hon KATE DOUST

I have been advised by the minister that the phrase “place where the care is provided” in regulation 23(2)(b) refers to the creche, not the building in which the creche is located. The intent of the exclusion for creches is that parents are nearby their children and therefore responsible for their children.
