I refer to section 86(b) of the
Building Services (Complaint Resolution and Administration) Act 2011, which
states that the Building Commissioner's function is to ''monitor
and review the operation of the building service Acts.''
(1) When will a
review of the building services act be carried out by the Building Commissioner
and be made available to the public?
(2) Why is the
government considering introducing a ministerial order to allow the
introduction of the Instant Start initiative, which will pose a significant
change to the building permit application process before a substantial review
has been undertaken?

I thank the honourable member for
some notice of the question.
(1) A review of
the operation and effectiveness of the building services acts will be carried
out as soon as practicable after the fifth anniversary of their commencement.
Reports based on these reviews will be tabled in each house of Parliament.
(2) When made,
the Instant Start ministerial order will expand the class of building work that
can be carried out without a building permit to include work by a registered
builder on single residential housing in the period between lodging a certified
application for a building permit and that permit being granted or refused.
This is a small adjustment to provide greater certainty of commencement date
and scheduling to house builders. Builders continue to evaluate how
implementation might operate.
The experience of using Instant Start
under the ministerial order will be considered as part of the review of the
Building Act 2011, which commenced operation in April 2012.
