(2) Section 34(1) and (2) of the Caravan Parks and Camping Grounds Act 1995 has not been proclaimed because the Local Government Act 1995, which was passed after the Caravan Act, provided for previous caravan local laws to continue to exist. Also, regulations made under section 34(6) deal with the transitional arrangements for caravan parks. Schedule 2, Clause 3 of the Caravan Parks and Camping Grounds Act 1995 was not proclaimed as it amended the Home Building Contract Act 1991 in a way that would result in home indemnity insurance not applying to park homes. This was not considered appropriate by the then Government and the clause was not proclaimed. Consideration is being given to repealing section 34(1) and (2) and Schedule 2, Clause 3. Section 11 of the Control of Vehicles (Off-road Areas) Act 1978 has not been proclaimed. It relates to the responsibility and liability of an owner of an off-road vehicle with respect to damage and/or injuries caused by under age drivers. In accordance with the then Premier’s undertaking, given in Parliament on 28 November 1978, section 11 was not proclaimed because of concerns about persons escaping liability as an owner of an off-road vehicle and the cost of third party insurance for such owners.
