Planning:
I refer to the minister's answer to question without notice 303
asked on Tuesday, 5 April that states —
� all matters surrounding Chevron will be dealt with by the former Minister
for Planning, the Minister for Health �
In reference to Elizabeth Quay —
(1) Under which section of the Metropolitan Redevelopment Authority Act
is this provided for?
(2) What administrative arrangements does the minister have in place to
allow this to happen?
(3) Has the minister sought advice or
information about the arrangements from the Public Sector Commissioner?
(4) What other matter will the minister need
to be excluded from?

I thank the member for some notice
of the question.
(1)–(2) The
appointment of an acting minister is provided for in the Interpretation Act
1984 and longstanding administrative arrangements are put in place in
circumstances such as these. These arrangements include an exchange of letters
between ministers explaining the potential conflict of interest and agreeing to
take on the relevant decision-making responsibilities as well as providing
advice to the affected chief executives of the agencies to ensure matters that
are directed to the appropriate minister. The process is discussed with the
Cabinet Secretary of Cabinet Services and the Premier is also advised as part
of the process of dealing with a conflict of interest.
(3) The Cabinet
Secretary administers the Ministerial Code of Conduct and therefore advice from
the Public Sector Commissioner is not required.
(4) I have been
informed by the chief executive officer of the Metropolitan Redevelopment
Authority that, at present, the MRA has no other matters concerning Chevron.
However, across my planning portfolio, I have also excluded myself from
decision-making in any future transient workforce accommodation policy and in
the Ashburton North strategic industrial area.
