MEMBER FOR BALLAJURA - RESPONSIBILITY FOR DAMAGE TO GOVERNMENT CAR
On 21 April the then Minister for Police and Emergency Services; Justice; Community Safety was involved in a crash in Subiaco when he was behind the wheel of his ministerial car. Insurance policies do not cover drivers involved in accidents when they do not have a valid driver’s licence. Given that at the time the then minister was driving illegally without a licence, will the Premier ensure that the former minister is held personally liable for any damage done to his government car and any other vehicle involved in the incident; or will the taxpayers of Western Australia be left to foot the bill? Mr A.J. CARPENTER

I thank the member for the question. First of all, let me point out something that is a hangover from the last question that the opposition asked, just to make sure that it is not acting under a misapprehension. Last Friday the member for Ballajura did have his licence. The question the Leader of the Opposition asked was whether people would be outraged to know that when we made the announcement on increased fines last Friday the minister was driving without a licence. He had his licence. An opposition member interjected. Mr A.J. CARPENTER : He had his licence last Friday. Mr T.R. Buswell : Whoopee! Mr A.J. CARPENTER : That was the question. Mr C.J. Barnett : It’s pathetic. Mr P.D. Omodei : Splitting hairs now. Mr A.J. CARPENTER : I love question time; it draws out all the characteristics of people and we can see who has humour and who has no humour, and who has vocabulary and who has none. On the opposition front bench is a member who has no humour and a vocabulary that consists of “disgraceful”. Mr C.J. Barnett : Who has a licence and who has not? Who drives on the road legally or illegally? Who drives on the road with a licence or without a licence? Mr A.J. CARPENTER : What was the other word? Mr C.J. Barnett : Who drives legally and who drives illegally? Only Labor ministers, it seems. Mr T.R. Buswell interjected. Mr A.J. CARPENTER : I have heard it said that the member for Vasse is the brightest of the bunch. At the moment, the member for Ballajura is taking court action to try to establish that his licence should not have been taken from him during that period, so that the licence will be retrospectively restored. Mr R.F. Johnson: It will be unsuccessful. Mr A.J. CARPENTER : If we had known that the member for Hillarys had such wisdom and perspicacity, we probably would have made him Chief Justice, rather than the person we recently appointed. At the moment the member for the Ballajura is going through a process that he hopes will have the outcome of restoring his driver’s licence. I do not have any legal opinion to demonstrate this, but my view is that if the member for Ballajura is behind the wheel of a car without a licence and has an accident, he is personally responsible for the damage. That is my view.

Mr C.J.
