I refer to a letter which I understand is dated January 3 2003 signed by Jim McGinty MLA, Acting Minister for the Environment and Heritage reference 16353 concerning Kalgoorlie Cement Works operated by Mr Mark Posa -
(1) Is it correct that part of this letter states ‘DEP officers first visited the KCW site on February 20 2002. It was determined that the operations should be registered under the
Environmental Protection Regulations 1987
, as it was likely the production capacity exceeded the 100 tonnes/year threshold, deeming the site a prescribed premise. This registration was completed on May 15 2002’?
(2) If no to (1), will the Minister table the letter dated January 3 2003?
(3) Can the Minister state the reasons why ‘it was likely the production capacity exceeded the 100 tonnes/year threshold’?
