A WA parliamentary question addresses concerns about a convicted paedophile profiting from a book/film deal related to their crimes and seeks government action to prevent exploitation of victims and recover proceeds. The Attorney General responds, stating existing laws are strong and will be applied, but he is unaware of the specific case and will seek advice.

I refer to news reports that convicted serial paedophile Robert Excell, who was released by the Attorney General, has signed a book and film deal while in prison to publish his memoirs on his vile exploits as a child rapist. (1) Why has the government failed to take immediate action to recover the proceeds of this deal under sections 15 and 16 of the Criminal Property Confiscation Act 2000? (2) What action does the Gallop government intend to take to prevent this further exploitation of Excell’s victims? (3) Will the Attorney General immediately instruct the Solicitor General to examine ways to protect the innocent victims of this notorious sex monster? Mr J.A. McGINTY

(1)-(3) We have in place in this state very strong laws which enable the confiscation of any ill-gotten gains. The full extent of that law will be applied in every case when it is drawn to our attention or when the authorities become aware of the circumstances, which includes criminals standing to gain from the publication of the circumstances of their offending, if any profit is to be gained from that area. As to the specific circumstances, I am unaware of the matters to which the member refers. I will certainly undertake to look into those matters, assuming there is some substance to them. I will seek advice on the matter.
