I refer the Premier to the letter from the Chairman of the Environmental Protection Authority to the Minister for the Environment dated 2 December 2002 containing the chairman’s advice on the due process to be followed in making a decision on the appeal, as required under the Environmental Protection Act 1986, including the requirement for the Premier to consult with the Minister for Planning and Infrastructure, as the other ministerial decision-making authority, and other key agencies before making his decision. (1) Did the Premier read the letter? (2) Why did the Premier not follow due process and consult with the other ministerial decision-making authority, as advised by the EPA chairman? (3) Why did the Premier not follow due process and consult with other key agencies, as advised by the EPA chairman, to enable him to make an informed decision? (4) In light of the failure of the Premier to consult with any other minister or obtain further advice from other agencies, on what basis does the Premier claim to have followed due process?
