INHERITANCE (FAMILY AND DEPENDANTS PROVISION) AMENDMENT BILL — REINTRODUCTION 98. Hon GEORGE CASH to the minister representing the Attorney General: I refer to the Inheritance (Family and Dependants Provision) Amendment Bill 2007, which was introduced into the Legislative Council on 27 November 2007 but which did not complete its passage through the house prior to the Labor government calling an early election in August 2008. Given that the bill was intended to update and modernise the law in relation to family provision and, in particular, provide the opportunity for a claim to be made against a deceased estate by a stepchild in limited circumstances, when will the current government reintroduce this legislation? Hon SIMON O’BRIEN

I thank the member for some notice of this question. The Attorney General has advised that the Inheritance (Family and Dependants Provision) Amendment Bill 2007 was, sadly, one of approximately 40 bills that lapsed because of the opportunistic early calling of the last state election. He advises that the bill has his general support, and he will seek to reintroduce it to cabinet as soon as is reasonably possible. Its time line will then be a matter for the manager of government business.
