I refer to the contracts for Building the Education Revolution (BER) projects in regional areas, administered by Department of Treasury and Finance – Public Works, and ask:
(a) do the BER contracts include ‘buy local’ provisions; and
(i) if not, why not;
(b) if ‘buy local’ provisions are included in contracts do these provisions specify that contractors building in regional areas purchase materials in the areas in which the construction is taking place; and
(i) if so, to what degree are contractors obliged to purchase locally;
(c) are ‘buy local’ provisions included in any other capital works contracts administered by the Department; and
(i) if not, why not;
(d) if no to (a) and/or (c), will the Treasurer undertake to include such provisions in future contracts for Government funded construction in regional areas; and
(i)
if not why not?

(a)        Yes
(i)         Not applicable
(b)        No.  The provisions of the Buy Local policy do not specify that contractors building in regional areas should purchase materials in the areas in which the construction is taking place.
A regional content preference of 5% may be claimed by a tenderer for the value of materials and services to be purchased from local businesses within a prescribed distance from the works.  If that tenderer is then successful, the contractor is required to purchase those materials and services locally.

(c)        Yes.  The State Government's Buy Local policy is applied to all Government funded construction tenders administered by the Department of Treasury and Finance (DTF).
