Will the Premier please advise the House whether he has received any further information on the status of the so-called legal advice being used by the Liberal Party to criticise the Government’s decision to reject a marina resort development on the Ningaloo coast? Dr G.I. GALLOP

I can report to the House that it is now 26 days since the Liberal Party state development spokesperson, Hon Norman Moore, first made reference in the Legislative Council to his unsourced legal advice. Let us remind ourselves of the issue. This issue is about a very important decision that the Government of Western Australia made on behalf of the people of Western Australia to ensure that the Ningaloo Marine Park and the Ningaloo Reef is properly protected for future generations. That is what this is all about. Hon Norman Moore has not revealed to the people of Western Australia the source of his so-called legal advice. I repeat the questions: who commissioned that legal advice, where did it come from and who paid for it? These are very important questions to which the people of Western Australia deserve an answer. The Government gave the honourable member plenty of time to answer the question. He would not answer it. We have had to ask the Leader of the Opposition where the legal advice came from. It has been interesting observing the comments by the various players in this matter. So far, we have had either deathly silence or very shifting excuses being delivered by all players on the other side of politics. Transcripts indicate that the developers at one point were reported as saying they provided the legal advice to the minister - then they said, no, that was not the case. The shadow minister in the upper House said that Hon Peter Foss was ruled out. The Leader of the Opposition then said he was satisfied that he did not have to intervene in the matter. I ask the Leader of the Opposition whether he knows where the so-called legal advice came from. Mr C.J. Barnett: No, no idea. Dr G.I.
