The Minister for Resources has been provided with the following response:
(1) Offshore petroleum operations are not currently administered under the
Offshore Petroleum Act 2006
(as mentioned in the question), as the instrument has not yet commenced.
Offshore petroleum operations occurring in State Waters are regulated under the
Petroleum Submerged Lands Act
1982 (PSLA 1982) and
Petroleum Act
1967 (PA 1967) and Commonwealth Water activities are regulated under the
Petroleum Submerged Lands Act 1967
(PSLA 1967
)
. The Department of Industry and Resources (DoIR) is responsible for regulating upstream petroleum operations, under both acts.
Under these acts, it is required that a monthly production report be provided to DoIR, detailing total quantities of produced formation water (PFW), hydrocarbon and gas produced. This is a requirement under Clause 652 of the
Petroleum (Submerged Lands) Acts Schedule - Specific Requirements As To Offshore Petroleum Exploration and Production
1995 (Offshore Schedule).
The only facility located in State Waters which does discharge PFW overboard is the Harriet Alpha platform. All other State offshore operations mentioned in the question re-inject the water into deep underground formations. All other facilities mentioned in the question are located in Commonwealth Waters and a number of those are not in Western Australian jurisdiction.
Volumes of PFW discharged into the ocean for financial year 2005/2006 from facilities mentioned are provided in Table 1 below. Please note the clarifications provided:
