1409. Hon NEIL THOMSON to the minister representing the
Minister for Police:
I refer to the answer to question
without notice 1344 on 5 November regarding the requirement for individual
volunteers registered with the Department of Biodiversity, Conservation and
Attractions as animal control agents to carry out activities when requested
such as euthanising wildlife. I note the answer to the question, too.
(1) If a correctly
licensed animal control agent is called on to euthanise a critically injured
animal, who are they required to seek
permission from if the activity needs to be carried out on a main road or state
highway ?
(2) Are they
required to have a separate letter for every road reserve listed on a different
road reservation?
(3) Is a separate
property letter required to euthanise a suffering animal if it is located
inside a fence line on a pastoral station or on unreserved crown land or other
crown reserves when the animal was injured on the road and had limped away to a
cadastral boundary?

The Western Australia Police Force
advises the following.
(1) The above
scenario is not one in which permission can be sought. It relies upon the
defence of emergency, as provided by section 25 of the Criminal Code Act
Compilation Act 1913.
(2) No.
(3) No; if the animal
is on an occupied property, contact with the occupier should always be made
wherever possible to advise of the emergency and actions planned.
