CERVANTES MARINE FUELLING FACILITY
I refer to question without notice 387 of 5 June 2007 regarding the Cervantes marine fuelling facility. I refer also to the minister’s letter sent to Comen Pty Ltd on 7 November 2006, in which the minister indicated that amendments to the Jetties Act Regulations were being pursued to provide DPI with more effective control of jetty usage. In that letter, the minister indicated also that changes to the Navigable Waters Regulations were being pursued to make it an offence to refuel a vessel within three kilometres of a jetty other than a licensed marine fuelling outlet. I ask - (1) Will these changes to the regulations be in place prior to the 2007-08 rock lobster season? (2) If not, why not? Hon ADELE FARINA

I thank the member for some notice of this question. (1) Amendments to the Jetties Act Regulations are proposed to be in place prior to the 2007-08 rock lobster season. However, the Department for Planning and Infrastructure has already overcome the problem of unauthorised fuelling on the jetty by negotiation with the involved parties. (2) DPI is still reviewing a number of issues relating to the suggestion to amend the Navigable Waters Regulations and the potential impact this may have on other locations and operations throughout the state. It is proposed to have the regulations in place prior to the 2007-08 rock lobster season. (4) Not applicable.
