The Legal Deposit Bill 2011 sets out the principles of legal deposit, with the details to be developed in Regulations following consultation with the parties that will be affected by the Bill (as required in Section 20). This is the same approach that has been taken to digital legal deposit in New Zealand and the United Kingdom.
Section 19(3) of the Bill provides for Regulations to be developed relating to access to or use of the copies of a public document, or of a WA Internet document, including by providing limitations on access and use.
The State Library is bound by the federal
Copyright Act 1968
and they are aware of the issues in relation to the copying and distribution of digital material without permission, whether that is from a commercial publisher or a community group. The implications of copyright were a major consideration in the drafting of this legislation.
The Act will come into operation in a staged approach following the development of regulations, and an extensive consultation phase to develop those regulations will be undertaken now the Bill has been passed by the State Parliament.
