(1) Is the Minister aware that in the Quarterly Consultants reports from January 1996 to July 1999, the following payments to Skea, Nelson and Hager are listed -
(a) to December 1998 - $87,299;
(b) January to June 1998 - $110,450;
(c) January to July 1999 - $17,870?
(2) Will the Minister confirm that the above list represents the complete list of contracts with Skea, Nelson and Hager?
(3) If not, what other projects has Skea, Nelson and Hager been contracted to undertake?
(4) What projects were undertaken for the above amounts?
(5) Were the above projects subject to the public tender process?
(6) If so, on what dates were the tenders advertised?
(7) If not why not?

The Minister Replied:
DEPARTMENT OF CONRACT AND MANAGEMENT SERVICES
(1) With respect to CAMS, the amounts listed in the Quarterly Consultant's Reports are as follows:
(a) July - December 1998 $87,299
(b) January - June 1998 $10,450
(c) January - June 1999 $17,870
The figure of $110,450 stated in the question under 1 (b) is incorrect. The correct amount is $10,450. In addition, the reports cover six monthly periods, not quarterly as stated in the question.
(2) - (3)
The amounts paid to Skea, Nelson and Hager in (1) were for legal advice on the Vehicle Fleet Funding Facility and were extracted from CAMS' "Six monthly return on the engagement of consultants report".
Skea, Nelson and Hager were also contracted (from a pre-qualified panel of leasing solicitors) to provide legal services relating to the Fremantle Justice Complex. These services were not deemed to fall under the scope of the above consultants report.

The amounts specified in 1 (a) - (c) were for the provision of legal advice in respect of the Vehicle Fleet Funding Facility.
(5) & (7)
Treasury advises that Skea, Nelson and Hager were engaged through the Crown Solicitor's Office.

STATE SUPPLY COMMISSION
(1) (a)-(b)-(c)
This part of the Question refers to CAMS and does not relate to the State Supply Commission. Prior to the compilation of the Consultants Report (for 1 January 2000 to 30 June 2000), the State Supply Commission classified contracts for legal service as a contract for service and not as a consultancy. The Consultant's report, covering the period 1 January 2000 to 30 June 2000, classifies legal services in the consultant's category.

The Consultant's report for the State Supply Commission, covering the period 1 January 2000 to 30 June 2000, classify legal services in the consultants category for the first time. Therefore the list of payments in the quarterly report for the period from 1 January 1996 to 30 July 1997 is incomplete.
(3)
During the period 9 December 1997 to 5 October 1999, the State Supply Commission paid an amount of $30,438 to Skea, Nelson and Hager to provide a Contracting Process Assessment for the Expression of Interest for Facilities Management of Offender Management Facilities issued by the Department of Contract and Management Services.

The payments detailed in Part 1 of the question do not relate to the State Supply Commission.
