I refer to Mining Lease 26/383 and the clearing of vegetation and removal of dirt and minerals with earthmoving equipment by Kalgoorlie Consolidated Gold Mines Pty Ltd employees/contractors for the construction of a mine haulage road used by road trains and other earthmoving equipment which commences at the approximate grid coordinates zone 51 (Northing 6598175, Easting 356815) at the intersection of Bulong road and generally runs in a southerly direction for approximately 350-400 metres -
(1) Is it correct that Mining Lease 26/383 still has a current tenement condition which states ‘Unless the written approval of the District Mining Engineer, Department of Mines, is first obtained the use of the scrapers, graders, bulldozers, backhoes or other mechanised equipment for surface disturbance or the excavation of costeans is prohibited. Following approval all topsoil being removed ahead of mining operations and separately stockpiled for replacement after backfilling and/or completion of operations.’?
(2) If no to (1), will the Minister table all the current tenement conditions?
(3) Can the Minister state the specific date on which Kalgoorlie Consolidated Gold Mines (KCGM) Pty Ltd applied and received written approval from the District Mining Engineer as per the condition mentioned in question (1) for the use of earthmoving equipment (bulldozer and grader) for surface disturbance and clearing of vegetation for the mine haulage road referred to above which intersects with Bulong road?

(5) Can the Minister quote the specific text of KCGM’s written application which clearly covers the seeking of written consent of the District Mining Engineer for the mine haulage road referred to above which intersects with Bulong Road?
