177. Hon ADELE FARINA to the
minister representing the Minister for Culture and the Arts:
I refer to recommendation 2 of WA Museum Report 286 titled ''Koombana
Bay foreshore maritime archaeological survey and excavations 21–28
November 2011'' that the maritime archaeological sites be protected and
managed under the Maritime Archaeological Act 1973 and the local planning
regime and the minister's answer to question without notice 67, stating
the shipwrecks have been protected under the local planning regulations only.
(1) When was
the decision made not to implement recommendation 2 in full and to protect the
shipwrecks under the local planning regime only?
(2) Who made the decision?
(3) What were the reasons for the decision?

I thank the member for some notice of the question.
(1) Recommendation
2 was that ''The City of Bunbury continue to work with the WA Museum to
establish processes for their long-term protection and management under the
Maritime Archaeology Act 1973 and local planning regime''. This has been
done.
(2) The
current exclusion zone agreed with the City of Bunbury was negotiated by the
maritime archaeology staff from the Western Australian Museum and endorsed by
the museum's independent expert Maritime Archaeology Advisory Committee
and, on its recommendation, by the chief executive officer of the Western
Australian Museum.
(3) The City
of Bunbury planning regulations afford additional and greater protection than
the Maritime Archaeology Act 1973. Furthermore, should any future development
of the site reveal further items covered by the act, they would also be
automatically protected and any potential damage would need to be mitigated
under appropriate arrangements to be agreed with the Western Australian Museum.
Given the member's interest in this matter, and the
significant amount of time required to provide sufficiently detailed responses,
I ask that future questions on this subject be put on notice, or, as offered
yesterday, the minister would be happy to arrange a briefing for the member.
