I refer to the Road Traffic (Vehicles) Regulations, and ask: (a) Do number plates issued with the prefix "MH" have to be compliant with section 117(3) and if not, why not; and (b) If yes, why are they presently issued in contravention to section 117(3)?

(a) No. The requirement to display a circular figure in the shape of a disc within the number plate only applies where there is more than one local district wishing to display the same letters. The circular disc is used to distinguish between two local districts displaying the same letters and numbers. In this case, “MH” is not duplicated in any other district from Mandurah, and therefore, is not bound by section 117(3) of the Road Traffic (Vehicles) Regulations.
